Project IC 33 The modelling of environmental risks in administrative and judicial proceedings

Scientific modelling of environmental risks is a progressively greater part of evidence in administrative and judicial proceedings. Administrative officials and judges are often unsure about how to handle such evidence, because the epistemological gap between science and law in respect of proof, risk, uncertainty, and predictive capability must be bridged. The project will explore the present state of evidence rules and practice both in common law and civil law systems in this regard taking New Zealand and Germany as representative examples. As a background, the law on coastal safety (infrastructure, regulation, environmental liability) shall be analyzed comparing New Zealand and Germany and including the relevant international law. In cooperation with IC 32 and 34 on morphological models, evaluation criteria for evidence from modelling shall be developed.
